XtremeX Operations - Traffic Light System

To make things easier with respect to the implementation of New Zealand’s new Traffic Light System, we have put together a page with everything you need to know.

Previously we announced that under the new system we would only be taking vaccinated persons via the MyPass, unless exempt.

However, new legislation guidelines released by NZ Transport states that any passenger service (SPSL, Taxi, Uber etc) must not refuse anyone wishing to use their service based on their vaccination status. After further consultation with MBIE, they have confirmed this position.
*SPSL (Small Passenger Service Licence)

Clarification - Who can use our services?
  • Vaccination Status Unapplicable (*Q&A) - Any persons wishing to book any of our experiences are not required to declare their vaccine status and are able to access all our services subject to the usual terms and conditions
  • Mask Wearing - Everyone, except for those exempt or under the age of 12 are required to wear a mask
  • Covid App – It is expected that customers use the covid app.
    • XtremeX members are all fully vaccinated

In summary both vaccinated and unvaccinated can use our services without declaring their vaccination status, again simply due to the SPSL that we are required by law to operate under (see Q&A). Please remember, we do not make any of these decisions we are only following the advice as required to ensure compliance operating under our SPSL.

For reference MBIE has provided their advice using the following resource:

Question: Surely XtremeX is an entertainment business or other close contact business?
Answer: In theory you would be correct, however as part of how we operate we are required by law to operate what we call an SPSL (Small Passenger Service License). In simple terms, anything that is a hire or reward is thrown into this category and therefore by law we are to uphold all compliance elements associated with these types of operations, including COF on cars, Loading Weights, NZTA Log Mate App (Worksafe requirements) and P-Endorsement for all drivers.

Question: Surely you can reclassify your business?

Answer: Unfortunately, that is not possible. Any business that takes MONEY for any passenger type service (defined as hire or reward) regardless of circumstance including; Rideshares, Uber, Taxi, Chauffeur, Balls, Weddings, they must all be registered either as an SPSL or Taxi.

The information supplied above has been put together under the advice we have received from MBIE and could change without notice due to the nature of the new traffic light system.
